These terms of use (“Terms“) apply to all websites linking to or posting these Terms and that are operated by The Pet Pet Shack Animals Accessories Trading Establishment, license number CN-2046278, issued from Abu Dhabi, or any of its divisions or affiliates (collectively, “The Pet Shack“, “we” and us“). Each such website is referred to in these Terms as a “Site“.

This Site is owned and operated by The Pet Pet Shack Animals Accessories establishment. Please read these Terms carefully before using this Site or any functionality on this Site. Our Privacy Policy is part of these Terms. Using the Site indicates that you accept these Terms. If you do not accept these Terms, please do not use this Site.

All design rights, compilation rights, and other intellectual property rights in and to this Site, in each case whether registered or unregistered and related goodwill are proprietary to The Pet Shack or its licensors.
7. Trademarks: All trademarks, service marks, logos, and trade names on this Site, whether registered or unregistered, are proprietary to The Pet Shack or to other companies where so indicated. You may not reproduce, download or otherwise use any such trademarks, service marks, logos or trade names without the prior written consent of The Pet Pet Shack or the appropriate owner thereof.

   1. Send or otherwise transmit to or through this Site any unlawful, infringing, harmful, harassing, defamatory, threatening, vulgar or otherwise objectionable material of any kind;

The Pet Shack will investigate any alleged or suspected violations and if a criminal violation is suspected, we will cooperate with law enforcement agencies in their investigations.

You represent and warrant that any information you transmit to the Site is truthful, accurate, not misleading and offered in good faith and that you have the right to transmit such information.

Any material that you transmit to this Site will be considered non-confidential and non-proprietary. 12. International Use: We control and operate the Site from our offices in the United Arab Emirates and all information is processed within the United Arab Emirates. We do not represent that materials on the Site are appropriate or available for use in other locations. Those who choose to access the Site from outside the United Arab Emirates do so voluntarily and are responsible for compliance with their local laws.

Certain of these third-party websites may make use of The Pet Shack trademarks, service marks, or logos under license from The Pet Shack. 14. Jurisdictional Issues: This Site is controlled and operated by The Pet Pet Shack from its offices within Abu Dhabi, U.A.E. Those who choose to access this Site from outside the U.A.E do so on their own initiative and are responsible for compliance with local laws, if and to the extent such laws are applicable.
15. Termination: The Pet Shack may terminate your use of this Site at any time in our sole discretion. Upon any such termination, you must destroy any content obtained from this Site and all copies thereof. The provisions of these Terms which contemplate surviving, including the provisions concerning Site security, prohibited activities, copyrights, trademarks, user submissions, disclaimer, limitation of liability, indemnity, and jurisdictional issues, shall survive any such termination.

No Guarantee: You acknowledge that The Pet Shack does not represent or guarantee the accuracy, reliability, availability, timeliness, performance, completeness or suitability of any of the materials or any other content available on this Site. You acknowledge that such content may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
17. Pet Pharmacy/Health Content: All content available in any pet pharmacy portion of this Site, or in any other health portion of this Site, is provided for informational purposes only. Such information is not intended to be, and is not, professional veterinarian advice or a substitute for such advice, or for diagnosis, treatment, cure, or prevention of any health conditions for your pet or any other animal, and you should not rely on them as such. You should always seek the advice of a veterinarian if you have any questions about any of the information you receive from this Site. The Pet Shack does not represent or guarantee that such information is accurate, complete, or timely.
18. Minors: Minors under the age of 18 are prohibited to register as a User of this website and are not allowed to transact or use the website.
19. Delivery Charges: All prices are inclusive FREE delivery for orders above 100 AED for Abu Dhabi based customers and above 500 AED for Dubai based customers..
20. Delivery Locations: Website/URL will NOT deal with or provide any services or products to any of the OFAC sanctions countries in accordance with the law of UAE.
21. Multi Shipments: Multiple shipments/delivery may result in multiple postings to the cardholder’s monthly statement.
22. Payment options: We offer Cash on delivery. We also accept payments online using Visa and MasterCard credit/debit card in AED currency.
23. Delivery time: Deliveries are done next day of order for orders placed before 6 pm. Orders placed after 6 pm will only be processed the next day and delivered the day after
24. Refunds: Refunds will be done only through the Original Mode of Payment
25. Information: If you make a payment for our products or services on our website, the details you are asked to submit will be provided directly to our payment provider via a secured connection.
26. Transactions: The cardholder must retain a copy of transaction records and Merchant policies and rules.
27. Currencies: the displayed price and currency selected by you, will be the same price and currency charged to the Card and printed on the Transaction Receipt.
28. Your Account: You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account from any devices, and you agree to accept responsibility for all activities that occur under your account or password. The Site shall not be responsible or liable, directly or indirectly, in any way for any loss or damage of any kind incurred as a result of, or in connection with, your failure to comply with this section.
29. Disclaimers: ALL OF THE CONTENT AVAILABLE ON THIS SITE IS PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND. THE PET SHACK DOES NOT MAKE ANY REPRESENTATIONS OR WARRANTIES REGARDING THE USE OR THE RESULTS OF THE USE OF THE CONTENT ON THIS SITE IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE. Limitation of Liability; TO THE EXTENT PERMITTED UNDER APPLICABLE LAW, UNDER NO CIRCUMSTANCES SHALL THE PET SHACK BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR INDIRECT DAMAGES RESULTING FROM THE USE OF, OR THE INABILITY TO USE, THIS SITE, EVEN IF THE PET SHACK OR AN AUTHORIZED REPRESENTATIVE OF THE PET SHACK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Applicable law may not allow some or all of this limitation of liability, so it may not apply to you.

Indemnity: You hereby indemnify, defend, and hold The Pet Shack and our affiliates, and our respective officers, directors, owners, agents, information providers, licensors and licensees, harmless from and against any and all liabilities and costs incurred in connection with any claim arising from your use of Site or your breach of these Terms. You shall cooperate with us in the defense of any such claim. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you hereunder.
32. Governing Law: Jurisdiction. Any dispute or claim arising out of or in connection with this website shall be governed and construed in accordance with the laws of UAE.
33. Country of Domicile: United Arab of Emirates is our country of domicile
34. Other: If any provision of these Terms is unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between the parties relating to the subject matter herein. Any failure or delay on our part in enforcing our rights under these Terms shall not be deemed a waiver of our rights. These Terms inure to the benefit of our successors and/or assigns.
